These Terms of Service are subject of the contract between the member and the company moove.

By filling out and sending the registration, you will become a member of moove online ("Service").
By using moove online and 'moove Roomancer' ("Software"), developed and operated by moove Bongartz – Dr. Kozan GbR, you agree to comply with the following terms and conditions. You must be fourteen (14) years or older to participate. If you are younger than eighteen (18) years, depending on your jurisdiction, you must have permission by your parents or legal guardian, to use this service.

  • Obligation
    You oblige not to post, offer, or make otherwise accessible, any material that is harmful, threatening, abusive, harassing, defamatory, hateful, racially objectionable, or otherwise unlawful in moove online, including, but not limited to, your personal profile page and websites, artwork, and documents displayed in your room. You also oblige not to behave in any way that is harmful, threatening, abusive, harassing, defamatory, hateful, racially objectionable, or otherwise unlawful in moove online. This also includes mentioning and spreading personal information, log files, including real names and "nicknames" of other members, on personal profile pages and linked websites (moove board). On request of the members mentioned on personal profile pages and linked websites, their nicknames, real names, nicknames before change, house names, e-mail-addresses, web links, and/or any other personal information have to be removed immediately. Furthermore, you are not allowed to reproduce, distribute, or otherwise use copyrighted work (art, literature, music, software, and other intellectual property) in moove online if the copyright is not held by any person involved. You are not allowed to advertise on nickpages and/or the moove board. You must not violate any local, state, national, or international law or regulation. If you allow another person to use your access to moove online, you hold the sole and complete responsibility for their actions conducted in your account. Orders by moove system administrators need to be followed.

  • Protection of Children and Young People
    Members of moove online additionally have to oblige by the moove child protection paragraph.

  • Harmful Conduct
    moove is fully committed to maintain a friendly and hospitable environment for the majority of our members. Unfortunately, like in any other social organization, there will always be some people who seek their personal enjoyment in harassing and disturbing other members. moove will not tolerate this kind of behavior. We will always try to contact such members first and do our best to give them a second chance. If the harmful behavior persists, we reserve the right to enforce a temporary or permanent ban. In such a case, there will be no monetary refund or any other compensation.

  • Sending and Receiving the moove Newsletter
    Newsletter will be sent when needed. By registering, the member agrees to receive moove newsletters.

  • Copyright
    The offered contents might be protected by copyright and/or by trademark. Their use is controlled by any valid copyright laws. Please see http://www.loc.gov/copyright/ for more information.

  • Impersonation
     Impersonation of any other person, especially of moove representatives and employees, is prohibited. This includes, but is not limited to, using nicknames or member profiles owned by a third party.

  • Credit Card Payment
    If, at the time of billing, the credit card cannot be charged, access to the Service will be restricted/cancelled until the payment has been made.
    Credit card owners who use “Chargeback” to recall the payment will be permanently excluded from the Service.

  • Limitation of Liability
    In no event can moove be held liable for content and programs distributes by our service or our members, nor for resulting damages, including, bit not limited to, damages caused by errors, delays or interruptions during transmission, incorrect content, olss or deletion of data, or viruses. moove reserves the right to edit or delete content that violates these terms in any way or is otherwise unacceptable.

  • Rights
    You have no right to claim membership in moove online.
    The Membership is free of charge. There is no right to a free nickname however. Moove reserves the right to delete nicknames without Gold Membership for any or no reason. moove reserves the right to cancel your Gold Membership at any time without notice and without further obligation to you. moove reserves the right to reject memberships and/or terminate memberships at any time for any reason whatsoever. If a member violates the Terms of Service, moove reserves the right to temporarily or permanently exclude this member from moove online. Furthermore, moove reserves the right to terminate the service at any time without notice and without further obligation to you.

  • Cancellation
    Free memberships don't have to be cancelled. The Gold Membership can be cancelled at any time. The member can cancel the Gold Membership himself/herself in the community under “Membership status” or send an e-mail with the subscription number to sales@moove.com. The cancellation has to arrive at moove by e-mail or postal service at least six days before the expiration of the billing period. moove cannot be held responsible for misdirected, delayed, invalid, or lost e-mails or written notices of withdrawal. The cancellation will come into effect at the end of the respective billing period. In no event will membership fees be refunded.

  • Disclaimer of Warranty
    You agree that use of the Service and the Software is at your sole risk. The service and the software are provided 'as is' and on an 'as available' basis. moove expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, warranty of merchantability, fitness for a particular purpose, or non-infringement. moove assumes no responsibility for any errors or omissions in these materials.

  • Technical Requirements
    It is not allowed to send software or data, which might damage and/or influence the recipient’s soft- and/or hardware. Every user is obligated to fulfill the technical requirements at all times and has to make sure his/her soft- and/or hardware or data originating from his/her computer does not impair the functions of the moove server, nor the functionality of the online service or 'moove Roomancer'.
    You may not modify, translate, reverse engineer, de-compile, disassemble, or create derivative works based on or incorporating the software, or remove any proprietary notices or labels it contains.
    For technical and operational reasons (e.g. automatic updating), moove servers occasionally need to access the contents of the moove installation folder.

  • Indemnification
    You agree to indemnify, defend, and hold moove, its officers, directors, shareholders, employees, agents, and assigns, harmless from and against any and all claims, demands, actions, costs, liabilities, losses, and damages of any kind (including court costs and attorneys' fees) resulting from your use of the Service and the Software, your breach of any provision of this Agreement, and/or any intentional wrongdoing by you.

  • Premium Package
     Requirement for the premium package is either the monthly gold membership subscription, the annual gold membership subscription, or the one-year gold membership. Members with premium package additionally have to oblige by the moove Premium Package paragraph.

  • Data Protection
    Data collected by moove for the online service is stored and processed on secure servers. For more information, see Privacy Policy.

moove reserves the right to change these Terms of Service at any time. If you do not agree with the changes, you can cancel your membership at any time. If you continue to use moove online with the knowledge of any such changes, it will be taken as your silent agreement with the changed Terms of Service.
